How to have an Enduring Power of Attorney made

Option 1

Contact the Public Trustee's office on 1300 746 116.

Option 2

Alternatively, download an Enduring Power of Attorney form. To nominate the Public Trustee as your sole Donee, insert the following at clause 1 of the form.

"I appoint the Public Trustee in and for the State of Western Australia of 565 Hay St, Perth to be my Donee."

Please note that the Enduring Power of Attorney will be ineffective until such time that the Donee (the Public Trustee) accepts the appointment as attorney by signing the required form "Acceptance by Donee".

If you choose to appoint the Public Trustee as your Attorney and you prepare the Enduring Power of Attorney yourself, you must forward the completed Enduring Power of Attorney to the Donee (the Public Trustee) to sign and accept in order for the Enduring Power of Attorney to be activated.

When does an Enduring Power of Attorney begin to operate?

An Enduring Power of Attorney can be signed and subsequently activated when the individual becomes incapacitated.

Alternatively, the Public Trustee can be requested to commence handling the financial and legal affairs immediately, thus relieving the burden of the collection of income, managing assets and paying accounts while leaving the persons free to enjoy life.
